Summary

BJ’s Wholesale Club has agreed to an administrative penalty of $27,000 to settle claims arising out EPCRA violations at its Uxbridge, Massachusetts distribution center. The facility consists of a 600,000 square foot warehouse on 30 acres of land that employees 200 people. BJ’s violated Sections 311 and 312 of EPCRA and 40 C.F.R. Part 370, Subpart B by failing to submit a Material Safety Data Sheet to the state emergency response commission, local emergency planning committee and fire department and failing to file Tier II chemical inventory forms for three calendar years for sulfuric acid, lead and diesel fuel present at the facility in a quantity above the minimum threshold reporting levels.
