On January 12, 2011, Region I issued an administrative compliance order (AO) and reporting requirement (RR) to Derecktor Shipyards Conn., LLC for violations of the Clean Air Act. Derecktor owns and operates a facility in Bridgeport, Connecticut where it manufactures marine vessels. The AO identifies violations of the Shipbuilding and Ship Repair (Surface Coating) NESHAP (Shipbuilding NESHAP), 40 C.F.R. Part 63, and the Title V operating permit program, in relation to surface coating operations that emit volatile organic compounds, hazardous air pollutants, and volatile organic hazardous air pollutants. Derecktor failed to provide required notices and submit to EPA an implementation plan for the Shipbuilding NESHAP and failed to apply to the Connecticut Department of Environmental Protection for a Title V operating permit.
