Summary

This referral seeks DOJ's assistance in recovering response costs from Rockney Weiss and AccuPress Printing, as an arranger for disposal of hazardous wastes and Richard Wilmer as the current owner of the facility that caused a release and threat of release of hazardous substances into the environment. This case involves a semi-trailer which ocntained numerous containers of print shop wstes, including but not limited to inks, thinners, etching materials and other wastes that are flammable, combustible, corrosive and toxic liquids. Mr. Wilmer purchsed the trailer from Mr. Weiss in March 2006. The trailer was parked at the site for an extended period of time. As a result, the City and County of Denver began enforcement of its codes which prohibit parking the semi-trailer at a residential property. In response, Mr. Wilmer unloaded all the containers from the trailer and placed them on the Site and removed the trailer. The containers, many of which were open, leaking, rusting, and/or dented, were located inside the house, in the back yard, and in an open dumpster. EPA initiated action to remediate the contamination at the site and the removal was completed in Feb. 2010.
