EPA Region 10 Settles Oil Spill Case with Hartley Farms & Feedlot LLC and Valley Trucking LLC Inc. for $34,000. On March 7, 2011, EPA Region 10 issued a Consent Agreement and Final Order settling claims against Hartley Farms & Feedlot LLC and Valley Trucking LLC Inc., for violating Section 311(b)(3) of the Clean Water Act, 33 U.S.C. § 1321(b)(3), which prohibits the discharge of oil or hazardous substances in harmful quantities into waters of the United States or adjoining shorelines. The violation resulted from a 2,400-gallon spill of diesel fuel into the Old Owyhee Improvement District Irrigation Canal, which flows into the Owyhee River, in Nyssa, Oregon on February 23, 2010. Both respondents took responsibility for the cleanup and have agreed to pay a penalty of $34,000 to settle this matter.
