Respondent is a medium dairy CAFO in Lisle, New York that is not complying with the terms and conditions of the NYSDEC CAFO General Permit. The facility was observed to be discharging from its bunk silo into a wetland that drains to the Nanticoke Creek, a water of the United States. Other permit violations include failure to exclude clean water from concentrated waste areas, failure to apply for and obtain coverage under the NYSDEC SPDES Construction General Permit, and failure to retain all records and reports for at least 5 years from the date reported. The Respondent also has not fully implemented its CNMP in accordance with the deadlines in GP-04-02. The Administrative Order is being issued to order the facility to immediately cease discharging silage leachate to the Nanticoke Creek, have the FacilityÂs silage leachate control system evaluated and designed by December 31, 2010, and fully implement all high risk practices identified in CNMP by September 30, 2011.
