On January 4, 2011, EPA Region III filed an administrative consent agreement and final order simultaneously commencing and resolving an administrative enforcement action against Air Products and Chemicals, Inc. for violations of Section 103(a) of CERCLA, 42 U.S.C. § 9603(a) and Section 304 of EPCRA, 42 U.S.C. § 11004 for failing to immediately notify the appropriate agencies in connection with ammonia releases on November 3, 2007 and November 20, 2008 at the Sparrow Point facility located at 2005 Reservoir Road, Sparrows Point, Maryland, 21219. Under the consent agreement, Air Products and Chemicals, Inc. has agreed to pay a cash penalty of $62,130 and perform a SEP. The SEP will entail installing and operating an aqueous sodium hypochlorite system, replacing its use of chlorine as a biological control agent on a specific water cooling system.
