Respondent owned or operated the City of Belen Waste Water Treatment Plant, a municipal owned and operated plant located in Belen, Valencia County, New Mexico. The facility is an industry subject to the General Permit for Storm water Discharges. On July 21, 2010, the facility was inspected by NMED and Respondent was found to be in violation of Section 301 of the Clean Water Act for failure to submit a Notice of Intent (NOI) for permit coverage for its activities at the facility.
