Summary

On April 26, 2010 ViaWest, Inc. disclosed potential violations of the Clean Air Act (CAA), and the Emergency Planning and Community Right-to-Know Act (EPCRA) at twelve data centers located in Colorado, Nevada, Oregon, Texas, and Utah. Pursuant EPA's Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations (Audit Policy), EPA determined that ViaWest's disclosures met the conditions of the Policy, and that no further action, and no assessment of civil penalties is required. Corrected violations included failure to comply with CAA State Implementation Plan (SIP) permiting requirements at the Las Vegas, NV facilities and EPCRA reporting under sections 311 and 312 for sulfuric acid, lead, and diesel fuel at twelve faciliites.
