On December 30, 2009, a consent decree (CD) resolving the cost recovery action the Department of Justice filed against three defendants associated with the Alabama Plating Company Superfund Site was filed in the U.S. District Court, Northern District of Alabama. The CD is a part of a global settlement involving the U.S., the cost recovery defendants, their insurance companies, and private attorneys representing the cost recovery defendants in their suit against the insurance companies which has continued for over 15 years. The defendants, who have no other assets, have agreed to turn over their share of an insurance settlement to the U.S. in exchange for resolution of the cost recovery case against them. Pursuant to the CD, the U.S. will receive $720,000.
