On March 1, 2011, Region 3 filed a Consent Agreement and Final Order (CAFO) simultaneously commencing and concluding an administrative action to resolve PCB rule violations at Lafarge North America, Inc.s (Lafarge) cement plant in Whitehall, Pa. The CAFO assesses a penalty for its violations of the PCB regulations. Specifically, Respondent stored combustible materials within 5 meters of PCB Transformers at 2 locations within the plant in violation of 40 C.F.R. § 761.30(a)(1)(viii). In addition, RespondentÂs annual document logs for 2005-2008 contained inaccurate statements regarding the quantities of PCBs in use and were not prepared on a calendar year basis as required by 40 C.F.R. 761.180(a). At the time of EPAÂs inspection of the cement plant, Respondent was using 3 PCB transformers containing 6,098 kilograms of PCB dielectric fluid.
