Henkel Corporation (Henkel) violated the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Miscellaneous Coatings Manufacturing, 40 C.F.R. Part 63, Subpart HHHHH (Subpart HHHHH) and the Ohio State Implementation Plan (Ohio SIP).
Specifically, Henkel is in violation of Subpart HHHHH because they failed to implement a leak detection and repair program and a startup, shutdown and malfunction plan. Additionally, Henkel failed to install and operate a control device flow indicator and failed to calculate and record the daily average condenser outlet temperatures. Lastly, Henkel exceeded the daily organic compound emission limit of 40 pounds per day, as required by the Ohio SIP.
The CAFO requires Henkel to pay a penalty of $148,000.
