On November 30, 2010, the Respondent self-disclosed under the Audit Policy possible violations at its St. Lawrence Psychiatric Center in Ogdensburg, NY for the Clean Air Act (CAA), Emergency Planning & Community Right to Know Act (EPCRA), Resource Conservation & Recovery Act (RCRA), and Clean Water Act (CWA). The facility failed to notify asbestos and refrigerant requirements for CAA; failed to submit complete Tier 2 reports for EPCRA; failed to manage large quantity generator hazardous wastes and manage hazardous pharmaceutical waste as hazardous wastes for RCRA; failed to train and inspect for the Spill Prevention & Control Countermeasure (SPCC) for CWA. Pursuant to the Audit Policy and based on information provided, EPA has determined that the facility meets the conditions of the Audit Policy for 100% elimination of the total gravity-based penalties. The Respondent corrected the violations that were disclosed on the November 30, 2010 Audit Policy request.
