This case addresses violations of the Clean Air Act (CAA) by Kennon's Auto Parts (Kennon's), a scrap and waste materials merchant based in New Albany, Mississippi. Kennon's imported 6 minitrucks on March 11, 2008. These minitrucks were not covered by an EPA issued Certificate of Conformity. The CAA requires, among other things, that motor vehicles be covered by an EPA issued Certificate of Conformity (see 40 C.F.R. Part 85, Subpart P).
On October 30, 2008, EPA requested that U.S. Customs and Border Patrol (CBP) seize the minitrucks and that CBP bring an enforcement action against Kennon's. As part of the settlement with CBP, Kennon's has agreed to pay a $993 civil penalty and to export or destroy the non-conforming minitrucks to resolve these violations.
