The City of Elk River, Idaho (City) has agreed to pay a $1,000 penalty to settle violations of the NPDES permit issued to the City for discharges from the CityÂs wastewater treatment facility. This enforcement action was resolved through an administrative consent agreement and final order pursuant to Clean Water Act section 309(g)(2)(B). The CityÂs wastewater treatment facility provides secondary treatment of wastewater prior to discharge into the Elk Creek. The wastewater treatment facility is part of a sanitary sewer system that receives domestic wastewater from residential and commercial sources. Between December 2005 and May 2010, the facility had 2,514 effluent limit violations of its NPDES permit. The facility exceeded its permit limits for Escherichia coli, biochemical oxygen demand, total suspended solids and total residual chlorine.
