This case addresses alleged violations of the Clean Air Act (CAA) by Sixty-Six (66) Wildfire Model WFB150-Q2 Off-Road All Terrain Vehicles, formerly known as Snyder Computer Systems d/b/a Wildfire Motors (Wildfire), an Ohio corporation headquartered in Steubenville. Wildfire imports and sells highway motorcycles and scooters, recreational vehicles, and small gasoline-powered equipment, all manufactured in China.
During the period from May 2009 Â June 2010, Wildfire imported 6,280 uncertified vehicles and equipment. These vehicles were uncertified due to discrepancies between information disclosed in WildfireÂs certification application and their actual design or configuration; specifically: (1) vehicle or equipment weight; (2) the engine displacement size; (3) missing catalyst; (4) different manufacturer; and (5) lack of disclosure (or full disclosure) of adjustable parameters.
Under the settlement, Wildfire forfeited the 2,072 vehicles and pieces of equipment which had been seized by United States Customs and Border Patrol.
