Summary

On March 26, 2015, EPA Region 10 and the Department of Justice settled with P4 Productions LLC for violations of CERCLA 103(a), EPCRA 304, and EPCRA 313. One of the Emergency Planning and Community Right-to-Know Act's (EPCRA) primary purposes is to inform citizens of toxic chemical releases in their areas. The CERCLA 103(a) and EPCRA 304 violations involved a failure to disclose releases of hazardous substances involving hydrogen cyanide, mercury, nitrogen oxides, and sulfur dioxide. Under EPCRA Section 313, facilities that manufacture, process, or use toxic chemicals over certain quantities must file annual reports estimating the amounts released to the environment, treated or recycled on-site, or transferred off-site for waste management. The failure to submit hazardous chemical inventory forms, the Toxic Chemical Release Inventory Report, is a violation of Section 313. The company agreed to pay a penalty of $600,000.
