On May 19, 2011, a Notice of Violation and Finding of Violation (NOV/FOV) was issued to Appleton Coated, LLC (AC), Combined Locks, Wisconsin, for violating requirements established in accordance with the Wisconsin State Implementation Plan (WI SIP), and ACÂs Title V Permit (issued June 17, 2002). Specifically, AC failed to submit the required initial notification, compliance reports, and notification of compliance status as required by 40 C.F.R. § 63.3400, Subpart JJJJ, the National Emissions Standard for Paper and Other Web Coating sources. Failure of AC to comply with Subpart JJJJ results in violations of its Title V permit; Section 502(a) of the Clean Air Act; 40 C.F.R. § 70.7(b); and the WI SIP. EPA discovered these violations through a review of a self-disclosure submitted by Appleton Coated on July 10, 2009, and August 20, 2009.
EPA is issuing a Consent Agreement and Final Order (CAFO). AC demonstrated compliance by submitting an initial notification for Subpart JJJJ and initiation all record keeping requirements. Under this CAFO, AC will pay a penalty of $15,000.
