U.S. EPA, Region 5 recently issued an administrative consent order (ACO) and consent agreement and final order (CAFO) under the Clean Air Act to Rubschlager for their facility located at 3220 West Grand Avenue in Chicago, Illinois. U.S. EPA issued a Notice of Violation to Rubschlager for violating the Illinois State Implementation Plan (SIP) by making modifications to its facility and constructing new emission sources without first obtaining construction permits or operating permits from the Illinois Environmental Protection Agency.
To come into compliance, the facility will be signing an ACO. This ACO requires Rubschlager to submit an operating permit application to Illinois Environmental Protection Agency, and to comply with that application while awaiting issuance of a permit. To resolve the past violations, U.S. EPA will also be simultaneously issuing Rubschlager a CAFO that will require the payment of a $66,000 penalty
