Summary

Pursuant to Section 309(a) of the Clean Water Act, EPA Region 10 has issued a compliance order to the City of Emmett, Idaho (City) for violations of the City's NPDES permit (Permit Number ID0020311). From October 2006 through August 2011, the City had 3,395 effluent limit violations of its NPDES permit. The wastewater treatment plant (WWTP) was routinely exceeding limits for biochemical oxygen demand, total suspended solids, total ammonia as N, total residual chlorine, fecal coliform, Escherichia coli and pH. In November 2008, the City's new $18 million WWTP went online which included an activated sludge process and UV disinfection. In August 2009, the new WWTP was taken offline due to a mechanical failure and the City has been diverting wastewater to the existing lagoon system for treatment. In 2010, the City took steps to mitigate continuing noncompliance with the effluent limits and completed an assessment to identify interim repairs that could be implemented at the existing lagoon system while the mechanical issues at the new WWTP are being resolved. In July 2011, the City provided EPA with a mitigation and construction schedule for the interim repairs at the existing WWTP. The compliance order requires the City to complete construction of the intemim repairs to the WWTP by January 1, 2012 and achieve compliance with the effluent limits by March 1, 2012.
