## Summary

EPA's claims against Allied under FIFRA Â§ 14(a) are based on an October 16,2008 inspection by Maryland Department of Agriculture (MDA)of a store in Baltimore. Maryland. MDA saw Smith & Johnson brand Antimicrobial Wipes on the store's shelves with labels making pesticidal claims such as  Antimicrobial Wipes  and  Kills most of germs.  The store had received these wipes from Allied's distribution center. MDA notified EPA and EPA sent Allied a Request for Information. From Allied 's response, EPA learned that Allied had received a large shipment of the wipes in July 2007 from an importer. Allied then distributed the wipes until April 2002 violating FIFRA.
