On September 26, 2001, a Consent Agreement and Final Order entered into by the U.S. Environmental Protection Agency, Region III (AEPA@) and BrandtÂs Farm Supply, Inc. (ÂRespondentÂ) was filed with the Regional Hearing Clerk settling alleged violations of the Federal Insecticide, Fungicide and Rodenticide Act, as amended ( FIFRA ). The alleged violations involved the failure to submit timely annual pesticide production reports for calendar years 2009 and 2010 in connection with RespondentÂs facility located in Elizabethtown, Pennsylvania. According to the CAFO, Respondent is assessed a penalty of zero ($0) for the alleged violations given that BrandtÂs Farm Supply, Inc. submitted reports showing zero production for calendar years 2009 and 2010, and requested that its establishment registration for the Elizabethtown, Pennsylvania facility be terminated. This action seeks to encourage pesticide producers to submit timely reports even if no pesticides are produced in a given calendar year. BrandtÂs Farm Supply, Inc. is a Pennsylvania corporation that retails farm equipment and products.
