This is an administrative penalty action pursuant to Section 312 of EPCRA and Section 103 of CERCLA issued to Univar USA, Inc at its facility located at 2600 South Garfield Avenue, Commerce, CA. The violations involve failure to immediately report a release to the National Response Center of a reportable quantity of a product containing more than 50 pounds of xylene into the environment from the facility. The facility also failed to report 689,000 pounds of nitric acid present on its facility since 2008 to the State and local agency as required under Section 312 of EPCRA. The respondent paid a penalty of $41,800 and came into compliance with the requirements.
