Region 1 settled an administrative action resolving EPCRA claims against 5N Plus (formerly MCP Metal Specialties, Inc.) of Fairfield, Connecticut. 5N Plus violated Sections 312 and 313 of EPCRA and EPAÂs regulations at 40 C.F.R. Parts 370 and 372 by failing to include certain chemicals in its Tier II and TRI reports for reporting years 2008-2010. Pursuant to the settlement, 5N Plus will pay a civil penalty of $13,250 to resolve the violations and will perform a supplemental environmental project worth $47,900.
