On March 5, 2012, EPA Region 6 issued a signed Consent Agreement and Final Order (CAFO) CWA-06-2011-1850 under its authority pursuant to the CWA Section 301 and CWA Section 309 to the City of Carlsbad located in Carlsbad, New Mexico. The signed CAFO was issued in response to violations of the EPA Storm Water Multi-Sector General Permit for Industrial Activities. The facility failed to reapply for permit coverage, develop and implement a SWPPP, and failed to develop and install BMPs. The signed CAFO requires the City of Carlsbad to develop and implement a SWPPP and appropriate BMPs and apply for permit coverage under the EPA SWMSGP. The City of Carlsbad has responded in the affirmative. The city has reapplied for permit coverage, is revising their SWPPP and has accepted the $7000.00 penalty.
