## Summary

On April 30, 2012, Region 1 issued a pre-filing consent agreement and final order (SuperCAFO) to Crystal Cold Storage and Warehouse, Inc., a company that specializes in cold food storage.  The facility is located in Medford, MA.  The SuperCAFO initiated and resolved EPA’s claim that Crystal Cold Storage violated the requirements of Section 312 of EPCRA, Section 325(c) of the Emergency, 42 U.S.C. § 11045(c), and the regulations promulgated thereunder, found at 40 C.F.R. Part 370.  Specifically, EPA alleged that Crystal Cold Storage failed to submit Tier II chemical inventory forms for three reporting years (2007, 2008, and 2009) for anhydrous ammonia in its refrigeration system and sulfuric acid stored at the facility (in quantities greater than the minimum threshold levels set forth at 40 C.F.R. § 370.10(a)(1) (formerly § 370.20(b)(1)) and 40 C.F.R. § 370.10(a)(2) (formerly § 370.20(b)(4)).  EPA settled the action for $17,000.
