On March 7, 2013, EPA Region 1 filed a Consent Agreement and Final Order (ÂCAFOÂ) to resolve an administrative penalty case against BioSensory Inc. (ÂBioSensoryÂ), a Delaware Corporation. The CAFO requires BioSensory to pay a $50,000 monetary penalty to resolve numerous past violations of the Federal Insecticide, Fungicide, and Rodenticide Act (ÂFIFRAÂ), as alleged in a complaint Region 1 filed on June 28, 2012.
The violations include 1) failure to file annual reports disclosing the type and amount of each pesticide product produced sold or distributed; 2) importation of hundreds of pesticides/devices into the United States without submitting the required reports (Notices Of Arrival or ÂNOAsÂ) with EPA; 3) distributed or sold misbranded pesticides/devices that did not display a valid EPA establishment registration number; and 4) distributed or sold registered pesticides/devices for an unregistered use. The settlement will encourage regulatory compliance and help to ensure that pesticides and pesticide devices are not sold or used in a manner that poses unreasonable risk to human health or the environment.
