On March 27, 2012, Region 1 filed a complaint alleging that Juan Hernandez, a landlord with offices in Bridgeport, Connecticut violated the requirements of the Known Lead-Based Paint and/or Lead-Based Paint Hazards Upon Sale or Lease of Residential Property (Disclosure Rule), 40 C.F.R. Part 745, Subpart F of TSCA. Specifically, EPA alleges that Mr. Hernandez failed to comply with the Disclosure Rule when he entered into seven leases for apartments located in Bridgeport, Connecticut between 2008 and 2010. All of the alleged violations occurred within environmental justice locations in Bridgeport.
EPA's case team and Respondent have agreed to settle this matter for a $69,000 penalty. to be paid over a period of six months.
