A storm water compliance inspection was conducted at the residential construction site known as Tierra Vista Subdivision, Santa Fe, Santa Fe County, New Mexico, on September 27, 2011, by the New Mexico Environment Department. It was determined at that time that the Respondent had not applied for permit coverage under the Stormwater Construction General Permit and had discharged pollutants to waters of the US on at least two occasions. An administrative order was issued on January 4, 2012, to address failure to apply for permit coverage and for failure to develop and implement a Storm Water Pollution Prevention Plan.
