On January 12, 2012, EPA Region III filed a Consent Agreement and Final (ÂCAFOÂ) that simultaneously initiated and resolved the alleged violations of Section 313 of the Emergency Planning and Community Right-to-Know Act ( EPCRA ), by Montgomery Chemicals, LLC (ÂRespondentÂ) at its chemical manufacturing facility located at 901 Conshohocken Road, Conshohocken Pennsylvania (ÂFacilityÂ). In the years 2006, 2007 and 2008, the Facility used methanol in excess of ten pounds, but filed inaccurate Toxic Inventory Release Forms for these three years. Prefiling negotiations resulted in the settlement that is memorialized in the Consent Agreement, which requires that Respondent pay a civil penalty. Respondent discovered the errors during planning of plant improvements and filed a self-disclosure. The company did not qualify for complete penalty mitigation, but was eligible for a 75% reduction in penalty.
