The complaint assessed a monetary penalty for unauthorized fill activities that were carried out at a location near the Ouachita River and Highway 2, Sterlington, Union Parish, Louisiana, beginning on July 1, 2009, and ending on October 1, 2009. The respondent did not have a CWA section 404 permit. The area impacted was on approximately 2.4 acres of bottomland hardwood jurisdictional wetlands west of the River. The wetlands impacted provided flood water storage for backwater from the Ouachita River. Respondent paid penalty of $1500.00 in response to Complaint. Fill has been removed and revegetation with hardwood seedlings has been carried out.
