On February 6, 2012, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 3008 of the Resource Conservation and Recovery Act (RCRA) to Dow Chemical Company (Dow) located in Plaquemine, Louisiana. The CAFO was issued in response to violations found under RCRA regulations. The CAFO requires Dow to pay a penalty in the amount of $200,000, implement a Supplemental Environmental Project (SEP) and perform injunctive relief. On December 11, 2013,as a result of communications between Down and EPA, SEP was removed from the CAFO and hte penalty was increased by $80,000.00
