Respondent owns and operates a marina in Diamond Point, NY. Stormwater associated with industrial activity from this Facility is discharged into Lake George, a navigable water of the US via direct surface runoff and storm drains located on the property. A duly authorized representative of EPA conducted an inspection of the Facility on September 1, 2010. The Facility failed to obtain coverage under the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity.
