Summary

EPA enter into and Administrative Compliance Order (ACO) with International Automotive Components Group North America, LLC (IAC). The ACO will require IAC to test the facility?s adhesive for the presence of toluene. The testing is required to confirm the facility obtained the correct Permit to Install from the state of Michigan. On December 6, 2010, EPA issued a Notice of Violation to IAC in Port Huron, Michigan alleging violations of the Clean Air Act and Michigan State Implementation Plan. Specifically, IAC had been operating an unpermitted process equipment at its Port Huron, Michigan facility since gaining ownership from Lear Corporation on April 9, 2007. The process equipment includes, but is not limited to: six Ucore lines, three AzDel lines, multiple assembly lines, a lamination line, and a foam manufacturing line. Lear Corporation was operating under a permit exemption, Michigan SIP Rule 290; however IAC did not maintain records in compliance with Rule 290 and may have altered the equipment in some way. We discovered these violations after part of a Violation Notice from the Michigan Department of Environmental Quality (MDEQ) went unanswered by IAC. IAC has failed to provide MDEQ with data to show potential emissions by the facility. Due to resource constraints at MDEQ, EPA is continuing the enforcement action.
