The Respondent is ordered to provide an approvable CSO LTCP to EPA/DEC by April 30, 2012 and to implement the LTCP by 12/31/2027. The Respondent was originally required to submit such an LTCP to the NYSDEC in 2001 and then, based on permit modifications, in 2004. The Respondent submitted an inadequate, late CSO LTCP to the NYSDEC in 2004. Implementation of the CSO LTCP will result in the Respondent's 52 CSOs not contributing to water quality standards violations and impairing water body uses.
