EPA, Region 3 has issued ten Administrative Orders and Information Requirements to Pennsylvania CAFOs that failed to submit Annual Reports to the state as required by their NPDES permits. The required Annual Reports contain important information about the CAFOs operations which enable regulators and the public to evaluate the operations of the CAFOs and their risk of surface water discharges.
The federal regulations establish a comprehensive list of Annual Report requirements, such as the amount of manure generated, the amount of manure transferred to third parties, a summary of manure, litter and process wastewater discharges, the crops planted, the actual yields per field and the calculations used to develop manure application rates. The stateÂs Annual Report requirements failed to include some of the federal Annual Report requirements, accordingly, the Information Requirements require the CAFOs to provide the missing Annual Report information for Annual Reports that had been previously submitted by the CAFOs, but which lacked complete information.
