This Administrative Order is in ICIS. On March 19, 2012, EPA issued under the authority of Section 3008(a) of RCRA a Complaint, Compliance Order, and Notice of Opportunity for Hearing (?Complaint?) to Al Kel Alliance, Inc., located in Wilmer, Texas. The Complaint sets forth Al Kel?s failure to comply with Subtitle C of RCRA and the regulations promulgated thereunder. These violations were identified during a Compliance Evaluation Inspection conducted on This civil inspection was conducted as a follow up to a criminal investigation that took place during the week of August 15, 2011. EPA?s CID reserves the right to seek penalty under their investigation, therefore, this Complaint serves to order Al Kel to return to compliance with RCRA. The Complaint orders Al Kel to address violations regarding the operation of a hazardous waste storage facility without a permit and its failure to make proper hazardous waste determinations.
