This case addresses violations of the Clean Air Act (CAA) by REG Biofuels, Inc. (REG), formerly known as Renewable Energy Group, Inc., a biofuel producer out of Ames, Iowa. On March 9th, 2009, REG informed EPA that it produced duplicate Renewable Identification Numbers (RINs) and RINs that were given an improper renewable fuel type designation ( improper D code ).
The Renewable Fuels Standard ( RFS1 ) regulations, promulgated by EPA pursuant to Section 211(o) of the Clean Air Act, are part of a comprehensive national program designed to inicrease the amountof renewable fuels used in motor vehicle in the United States, thereby reducing the nation's reliance on foreign crude oil.
REG informed EPA that the duplicate and improperly designated RINs were generated as a result of a change to REG's information technology platforms. REG informed EPA that REG has developed and implemented procedures to ensure future compliance. REG also worked with EPA to implement appropriate remedial actions to recall the duplicate RINs. As part of the settlement with EPA, REG has agreed to pay a $266,000 civil penalty.
