This municipality (as defined by 40 CFR 122.26) has not applied for coverage under the Small Municipal Separate Storm Sewer (sMS4) General Permit. An inspection was conducted by the New Mexico Environment Department (NMED) on November 15, 2011. It was determined at thiat time that runoff from the approximately 246 acre site did enter the stormwater conveyences of the Albuquerque MS4. An order was issued to address lack of permit coverage and ordered the EXPO New Mexico to cease and desist discharging contaminated stormwater to the Albuquerque MS4, thence to waters of the U.S.
