Summary

This Order requires performance of removal actions in connection with the release of oil at or from a facility (Wellington Township Garage) located at or about State Route 58 and Maple Street in Wellington, OH. This Order requires the Respondents to immediately conduct removal of a discharge or to mitigate or prevent a substantial threat of a discharge of oil. According to the NRC report, at approximately 11:02 pm EST on 1/12/2012, Respondents' pipeline (an 8-inch pipe) began discharging an unknown quantity of gasoline above ground and into a storm drain. The lower explosive level of gasoline spilled to the soil in some locations exceeded the 10% requirement that measures be taken to mitigate fire and explosion hazards. EPA determined that the discharge contaminated approximately a 200- by 75-yard area above ground by the storm drain and flowed into the drain. The drain is called the White Ditch and has water flow within it. The White Ditch eventually discharges into the Black River which is approximately 3 miles downstream of the spill location. The Black River and White Ditch are navigable waters of the United States.
