## Summary

Albuquerque is a Phase I Municipal Separate Storm Sewer System (MS4), and as such, is required to comply with the permit that requires them to develop and implement a component to their Stormwater Management Program that controls illicit discharges to the MS4 and waters of the US.  An inspection was conducted at the site of the EXPO New Mexico and The Downs, which are the fairgrounds and a racetrack located at the fairgrounds.  The EXPO did not have permit coverage but did discharge to the Albuquerque MS4.  Albuquerque should have at least worked with the EXPO to stop its unpermitted contaminated stormwater discharges but failed to do so.  A cease and desist administrative order was issued to Albuquerque ordering them to submit a written schedule of compliance for the elimination of non-stormwater discharges from the EXPO New Mexico to the Albuquerque MS4, to submit a Plan of Action to eliminate all unpermitted discharges to the MS4, and to submit a list of funding sources for implementing the Illicit discharges and Improper Disposal program.
