During an EPCRA 311/312 inspection conducted on 6/18/2008, it was determined that the facility had carbon dioxide on-site during calendar years 2006 and 2007 in amounts equal to or greater than its minimum threshold level. As of 6/18/2008, Respondent had not submitted Tier II forms and MSDSs for carbon dioxide for calendar years 2006 and 2007 to the SERC, LEPC and Detroit Fire Department.
