Summary

On April 17, 2012, the EPA and Robert M. Loomis and Nancy M. Loomis of Kilgore, Texas, have signed an Administrative Order on Consent (Consent Order) regarding the restoration and mitigation required to resolve the unauthorized placement of fill material into wetlands and other waters of the United States alleged by the EPA on the Respondent’s property located in Haines, Alaska (Site). Additionally, Mr. and Mrs. Loomis agreed to pay a $22,500 civil penalty for claims stemming from the unauthorized filling as well as discharges of stormwater from a construction site without a NPDES permit. The Consent Order (EPA Docket No. CWA-10-2012-0122) requires Respondents to submit to the EPA, for review and approval, a Restoration and Mitigation Work Plan (Plan) within 45-days from the effective date of the Consent Order. In addition to the removal of approximately 0.35 acres of fill material, the Loomis’s will undertake fish habitat enhancement work around a culvert placed in a salmon-bearing stream. Annual monitoring reports shall be submitted to EPA for three consecutive years after completion of restoration activities.
