The Consent Agreement resolves violations of: Clean Air Act (CAA) federally-approved and federally-enforceable permitting and recordkeeping requirements for emergency generators contained in the Alabama, Nebraska, Ohio, Tennessee, and Washington State Implementation Plans; the CAAÂs New Source Performance Standards regulating the sulfur content of fuel used in stationary compression ignition internal combustion engines; the Clean Water ActÂs (CWA) Spill Prevention, Control, and Countermeasure (SPCC) Plan requirements; and the Emergency Planning and Community Right-to-Know Act (EPCRA). EPA and Charter Communications, Inc., (Charter) entered into a corporate audit agreement in late 2009. Under the audit agreement, Charter assessed CAA, CWA, and EPCRA compliance at nearly 1,500 of its telecommunications facilities and disclosed violations at 136 facilities pursuant to EPAÂs Audit Policy. Charter corrected all of the disclosed violations and paid a $57,313 civil penalty.
