Summary

On February 24, 2012, the Respondent self-disclosed a possible Clean Water Act violation at its facility, located at Street No. 2, Km 30.2, Ponderosa Ward, Vega Alta, Puerto Rico to the U.S. Environmental Protection Agency (EPA), pursuant to EPA’s Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations (Audit Policy). The facility failed to apply for a Multi Sector General Permit and has since applied for the permit and was approved by EPA. The facility corrected all issues and has developed and is implementing a Storm Water Pollution Prevention Plan. Pursuant to the Audit Policy and based on information provided, we have determined that the facility meets the conditions of the Audit Policy for 100% elimination of the total gravity-based penalties. In addition, the potential economic benefits associated with the violation are ‘de-minimis’ and are also waived.
