EPA'S ENFORCEMENT ACTION WAS INITIATED AFTER A COMPLAINT WAS MADE BY A LESSEE AND RESIDENT OF WEYLAND APARTMENTS ON OR ABOUT JAN 3, 2011. ON FEB 7, 2011, REGION 4 CONDUCTED AN INSPECTION AT WEYLAND APARTMENTS, TO DETERMINE MW GROUP'S COMPLIANCE WITH 40 CFR PART 745, SUBPART F. BASED ON THE FINDINGS OF THE INSPECTION, REGION 4 IDENTIFIED NUMEROUS VIOLATIONS OF THE DISCLOSURE RULE AND THE REGULATIONS SET FORTH AT 40 CFR PART 745, SUBPART F. ON APRIL 13, 2011, REGION 4 ISSUES A NOTICE OF VIOLATION (NOV) TO MW GROUP ALLEGING 123 VIOLATIONS ASSOCIATED WITH 20 SEPARATE LEASES. THE NOV ALSO INCLUDED A PROPOSED CIVIL PENALTY.
ON SEPT 29, 2011, REGION 4 HELD A SHOW CAUSE MEETING WITH MW GROUP TO DISCUSS THE MERITS OF THE VIOLATIONS AND THE PROPOSED PENALTY. SUBSEQUENTLY, MW GROUP SUBMITTED SUPPORTING DOCUMENTATION TO THE REGION FOR CONSIDERATION.
