On multiple dates between April 2007 through May 2008, respondent discharged dredged/fill material from point sources, including earth-moving equipment in, on, and to an eight-acre tract within the subject property (Megan's Way Subdivision)without a permit issued by the US Army Corps of Engineers. Complaint proposes to assess a Class II civil penalty. After Hearing and financial review, penalty reduced to $500 for ability to pay concerns.
