Respondent is a permitted MS4 in Elmira, NY. An MS4 Audit was conducted from October 17-18, 2011 and identified the Respondent was not complying with the terms and conditions of the NYSDEC SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems. An Administrative Order was issued on March 29, 2012 (CWA-02-2012-3027) to order the municipality to comply with Permit conditions. Injunctive relief was already calculated for the Order issued on 3/29/2012. The current Order establishes a revised compliance schedule for addressing the items listed in the Order.
