On April 17, 2012, the Agency published notice of a proposed administrative settlement under 122(h) of CERCLA with the Estate of Benjamin C. Schilberg for recovery of past costs concerning the Cadlerock Properties Superfund Site in Ashford and Willington, Connecticut. The settlement is based upon the settling partyÂs ability to pay and requires payment of $170,000 to the Hazardous Substance Superfund. The settlement includes a covenant not to sue the settling party pursuant to Section 107(a) of CERCLA. The Site consists of approximately 335 acres surrounded by residential and undeveloped properties. Although the Site is currently inactive, from 1967 through 1972 Benjamin Schilberg operated a copper recovery and resale operation on a portion of the Site. The operations resulted in the disposal of hazardous substances, which were left on-site. EPA has incurred approximately $4.3 million, including interest, at the Site. The Agency will receive written comments related to the settlement until May 17, 2012
