6/5/2012 - CONSENT AGREEMENT AND FINAL ORDER ISSUED, ASSESSING A PENALTY OF $8,923. RESPONDENT SHALL MAKE PAYMENT WITHIN EIGHT INSTALLMENT PAYMENTS. THE FIRST PAYMENT OF IS DUE WITHIN THIRTY DAYS OF THE EFFECTIVE DATE O THIS CAFO. ALL SUBSEQUENT SEVEN PAYMENTS SHALL BE DUE IN 90 DAY INTERVALS THEREAFTER. THE LAST PAYMENT IS DUE WITHIN 660 DAYS.
ORDER ALLEGES:
RESPONDENT OWNED, LEASED, OPERATED, CONTROLLED OR SUPERVISED THE DEMOLITION OPERATION AT THE FACILITY.
DEMOLITION OCCURRED BETWEEN MAY 1, 2011, AND SEPTEMBER 29, 2011, AT A FACILITY LOCATED AT 500 MARSHVIEW CIRCLE IN BRUNSWICK, GEORGIA (THE FACILITY).
THE FACILITY BEING DEMOLISHED WAS AN EIGHT-UNIT CONDOMINIUM BUILDING THAT WAS KNOWN AS THE 500 BUILDING AND HAS BEEN USED FOR RESIDENTIAL PURPOSED AS A PART OF THE MARSHVIEW CONDOMINIUMS.
RESPONDENT VIOLATED SECTION 112 OF THE CAA, 42 U.S.C. SECTION 7412, AND 40 C.F.R. SECTION 61.145(b) BY FAILING TO PROVIDE THE STATE OF GEORGIA WITH WRITTEN NOTICE OF INTENTION TO DEMOLISH THE FACILITY.
