On June 12, 2012, EPA and Formosa Plastics Corporation, Texas signed two agreements: (1) A RCRA 3008(a) Consent Agreement and Final Order (�CAFO�); and (2) An Amendment to a 1991 RCRA 3008(h) Administrative Order on Consent (�AOC�). The CAFO was filed with the Regional Hearing Clerk on June 14. These two legal mechanisms resulted from settlement negotiations and administrative litigation to achieve facility-wide corrective actions to address historical RCRA releases of hazardous wastes (ethylene dichloride) and constituents into the groundwater. Long-term site-wide remediation cost estimates are approximately $20,000,000 for the first five years. Formosa plans to apply for a post-closure permit (�permit�) or post-closure order (�order�) from the TCEQ within 2 years. EPA has coordinated and will continue to coordinate with the TCEQ to ensure that the elements of the CAFO and AOC which are not completed are included in the Permit or Order.
